Terms of Service
Article 1 – Definitions
1.1 TrackBacked: the online platform where users can receive paid feedback from professional artists, either through recorded video feedback or live sessions.
1.2 User: a person who books a session or requests a video feedback from TrackBacked to receive feedback on their music.
1.3 Artist: a professional who provides feedback to users through TrackBacked.
1.4 Payment Provider: external party Mollie, which processes payments.
Article 2 – Use of the Platform
2.1 TrackBacked offers a service where users can purchase feedback from professionals selected from a curated pool.
2.2 For video feedback, the user fills out a Jotform form with a link or upload to their track and selects a professional for feedback.
2.3 TrackBacked processes each request and forwards video feedback after a quality check.
2.4 The platform may not be misused for inappropriate content, spam, or any other unlawful activity. Respectful behavior is mandatory at all times.
2.5 All activities conducted through Jotform are subject to Jotform’s terms and conditions. By using TrackBacked via Jotform, users agree to these terms.
Article 3 – Payment and Refund Policy
3.1 If video feedback is not received within 10 business days, the user will receive a refund to the same account used for payment.
3.2 Once video feedback has been delivered, refunds are no longer possible. Complaints can be submitted via this form or via email.
3.3 TrackBacked uses the external payment provider Mollie, and their terms and conditions apply to all transactions.
Article 4 – Feedback, Conduct, and Liability
4.1 TrackBacked cannot guarantee the quality or outcome of feedback but strives to maintain high standards by selecting qualified professionals. Feedback is subjective and advisory in nature.
4.2 TrackBacked is not responsible for any damages, losses, or consequences resulting from the use of the platform, including technical failures or dissatisfaction with feedback.
4.3 TrackBacked reserves the right to reject any feedback request. In such cases, a refund will be issued.
4.4 If a reviewer becomes unavailable, the option to select them will be temporarily disabled. Existing feedback requests will still be processed.
4.5 Submitted music longer than 8:00 minutes will not be reviewed in video feedback. A refund will be issued in this case.
Article 5 – Complaints Procedure
5.1 Complaints about received feedback can be submitted via this form or through email.
5.2 All complaints will be reviewed and responded to within 5 business days via email.
Article 6 – Data Protection and Privacy
6.1 TrackBacked only collects the information submitted through the Jotform forms.
6.2 Submitted music remains the property of the user and will not be used by TrackBacked for promotional purposes without explicit permission.
6.3 Artists are contractually obligated not to share or distribute received music or video content without permission.
6.4 Video recordings are not stored by TrackBacked unless agreed upon in advance with the user.
6.5 Personal data is retained for a maximum of one year after completion of the process. Users may request deletion at any time by contacting info@trackbacked.com.
Article 7 – Changes and Applicability
7.1 The terms and conditions applicable at the time of payment or booking apply to that specific transaction or session.
7.2 TrackBacked reserves the right to modify these terms at any time. Changes will be published on the website.
7.3 In the event of disputes, Dutch law applies, and disputes will be submitted to a competent Dutch court.
